MANHATTAN (CN) -Smiffy's, a century-old costumier, says Michael Jackson's death prompted a rival to claim falsely that Ruby's Costume Co. is the only business authorized to sell the King of Pop's costumes.
Smiffy's says it has sold costumes approved by MJ Licensing since 2008.
Ruby's Costume Company never sold Michael Jackson costumes until the after the star's death in August, Smiffy's says in its federal complaint.
Since then, Ruby's Executive Vice President, Howie Beige, allegedly has sent emails to Smiffy's customers and to the press claiming to be the "only authorized licensee" to sell Michael Jackson costumes.
Smiffy's says Ruby's false claims could cost it $250,000 in lost business.
Smiffy's wants a retraction, an injunction for false advertising and treble damages.
