Copyrights aren’t transferred verbally

RENO, Nev. — A Nevada federal court entered summary judgment in favor of a ski guide company, which sued a sled guide firm for using the former’s photo in the background of the latter’s website homepage. The sled guide firm had filed a breach-of-contract counterclaim because the owner allegedly bought the rights to use the ski guide company’s photos for $100 in an oral agreement. The court holds that a copyright interest cannot be “conveyed by mere oral agreement” and awards the ski guide company over $47,000 in damages.
