Cop Says Gay Porn Actor Harassed Him

RICHMOND, Va. (CN) - A gay porn actor took advantage of a FaceTime misdial to wage an extended campaign of social media and other harassment against a police officer innocently seeking advice about a gun, the officer claims in court.

In a circuit court complaint filed on Monday, Richmond City police officer Centell Colonzo McNeil claims he inadvertently sent a series of texts to Juan Davila, of Fort Lauderdale, Fla., seeking technical advice on a carbine assault rifle he'd just purchased.

McNeil says he believed he was calling a gun-savvy friend he'd made in the National Guard, and when he received no response to the initial flurry of texts, he placed a FaceTime video call to the number.

Surprised when Davila answered the call with a blue video camera in hand, McNeil apologized for the misdial and explained that he was a police officer.

He claims he later received several harassing phone calls from Davila at a blocked number, as well as text messages propositioning him for oral sex.

Davila also allegedly revealed he'd captured several screen shots of McNeil and his rifle during the initial FaceTime call, and threatened to post them on social media.

But the alleged harassment didn't stop there, McNeil says.

Davila allegedly hacked into a friend's email account and sent McNeil a message which said, "go pick cotton you nigger," the complaint says.

McNeil says he told Davila he would go to the police if the harassment did not stop, to which the porn actor replied, "and so will the email about you threatening to shoot me."

Davila made good on the threat and posted photos of McNeil holding the gun on his personal Facebook account as well as the Twitter account he used for his porn company, Biaggi Productions LLC.

In his social media posts, Davila claimed to have received more than 25 video calls of McNeil displaying his gun on camera, court documents say.

"Specifically, the picture in the Twitter post displayed plaintiff's upper body and face, with plaintiff wearing a white tank undershirt, holding a rifle in his right hand, and with Plaintiff's personal gmail address listed on the top left of the picture," the complaint says.

Davila also posted McNeil's email address, phone number and incorrect home address in Hopewell, Va. to the social media accounts which "feature a graphic depiction of ... bubble letters of the website name 'biaggivideos.com' smeared in a white-colored graphic representation depicting a semen-like substance," court documents say.

Translated from Spanish, Davila's Twitter post allegedly reads, "this [bastard] [motherfucker] [similar derogatory term] from Hopewell, Virginia FaceTime calls me that he is going to kill me. The police are in my house for more info later."

McNeil says he never threatened to shoot anyone and that there is no police record of a call to Davila's house that day.

Nonetheless, Davila filed false accusations of murder threats against McNeil with the Richmond Police Department and the FBI, causing McNeil to receive a work suspension and revocation of overtime pay, the complaint says.

McNeil seeks $14 million in damages on multiple defamation claims and for the unauthorized use of his image.

He is represented by Bret Mooney of Thomas H. Roberts & Associates of Richmond.

Davila did not respond to a request for comment from Courthouse News.
