Constructive Discharge

MONTGOMERY, Ala. – A former fire department’s chief of operations, who resigned after he was charged for domestic violence for “at least” the eighth time in his career, may pursue his due process and breach of contract claims against the city of Montgomery, a federal court in Alabama ruled. The plaintiff argues he was constructively discharged and not compensated for accrued annual leave or sick leave.
