WILMINGTON, Del. - FuelCell Energy claims a 2011 Delaware law amending the state's Renewable Energy Portfolio Standards Act gives in-state, "crony" companies preferential treatment in contracts, in violation of the Commerce Clause and the 14th Amendment, in Federal Court.
