Confederate Memorial

The Supreme Court of Alabama ruled that the City of Birmingham violated the Alabama Memorial Preservation Act by placing a plywood screen around a Confederate memorial. 

BIRMINGHAM, Ala. – The Supreme Court of Alabama ruled that the city of Birmingham violated the Alabama Memorial Preservation Act by placing a plywood screen around a Confederate memorial. 

The lower court ruled that the city’s First Amendment rights were violated because the memorial conveys a message it did not wish to promote. The state’s Supreme Court, however, ruled that the city cannot be equated with an individual citizen and does not have the same inherent rights.
