Hexion Specialty Chemicals sued Huntsman Corp. in Delaware Chancery Court, claiming it is not liable for the $325 million termination fee if their proposed merger fails. Hexion believes Credit Suisse and Deutsche Bank may back out of financing the deal due to Huntsman's increased debt and decreased earnings.

Plaintiffs in the Hexion v. Huntsman case include 20 Apollo investments funds.
