‘Come Back With That Porsche!’

WEST PALM BEACH (CN) - A fired worker bought himself a Porsche with a company credit card and sold it two days later, the AMEX Bank of Canada claims in court.

AMEX sued Donald Dunbar, Brumos Motor Cars and Braman Motors, in Palm Beach County Court.

Dunbar worked for nonparty Platinum Flight, of Dorchester, Ontario, Canada, and had a company credit card, AMEX says in the complaint.

AMEX does not say what Dunbar did there, but it says he was fired on Feb. 27. Platinum Flight told him to return his American Express Small Business Card, and he said he had thrown it away, according to the complaint.

But apparently not.

"On or about March 5, 2013, defendant Donald Dunbar charged to the canceled American Express Canadian Small Business card issued to him as a supplemental card holder on the account of Platinum Flight the sum of $135,200 to purchase a 2013 Porsche 911 C4 motor vehicle from defendant, Brumos Motor Cars, Inc.," the complaint states.

Two days later, "On or about March 7, 2013, defendant, Donald Dunbar, sold to defendant, Braman Motors, Inc., the 2013 Porsche 911 C4 motor vehicle he purchased from Brumos Motor Cars, Inc.," according to the complaint.

AMEX says that through "mistake and inadvertence" it approved the $135,200 payment to Brumos Motors.

Brumos has not yet given title to the car to either Dunbar or Braman, AMEX says.

Nor should it, the bank adds. Nor should Braman Motors "transfer to defendant, Donald Dunbar, the proceeds of that sale."

AMEX says that under its card member agreement, it cannot seek payment from Platinum Flight or Dunbar.

AMEX asks the court to declare it the equitable owner of the Porsche and enjoin the title transfer from Brumos Motor Cars to either Dunbar or Braman Motors.

Amex is represented by Joel Lumer in Boca Raton.

Braman Motors is in West Palm Beach.

Brumos Motors is in Duval County, whose seat is in Jacksonville, 285 miles from Palm Beach.

Dunbar lives in Toronto.
