Colorado water disputes

DENVER — The Colorado Supreme Court ruled that a portion of the state’s water law does not create a private action for property owners to sue neighbors who have diverted excess water to their property, causing waste and flooding. Only the state engineer can bring enforcement actions against irrigators suspected of running excess water through their ditches and easements.
