ELECTIONS - The Colorado Supreme Court ruled, en banc, that a proposed public trust standard initiative violates the single-subject requirement of the state Constitution, since the legislation contains the additional subject of a public trust standard for agency decision-making. Kemper v. Hamilton
TORT - In a matter of first impression, the Colorado Supreme Court held that recovery of compensatory damages in a skiing-related wrongful death action is limited to $250,000 under Colorado's Ski Safety Act. It also held that the felonious killing exception in Colorado's Wrongful Death Act, which provides for unlimited compensatory damages, does not apply to this action. Stamp v. Vail Corporation
