Colorado Appeals Court

VETERANS, PENSIONS - The Colorado Appeals Court vacated part of a ruling that money received from the Veterans Administration and the Colorado Old Age Pension Program may be applied to cover costs incurred by patients at the Colorado Mental Health Institute.

J. Terry found that under Colorado's Charges for Patients Act, the plaintiffs' benefits were properly deemed available to pay for the costs of their care. However, the trial court lacked jurisdiction over plaintiffs' claim for breach of fiduciary duty. Nau v. Colorado
