College Wins Ruling on Access to Student Exams

(CN) - Colleges are not required to provide students with copies of midterm and final exams, a California appeals court ruled. Rafi Moghadam sued the Regents of the University of California at Los Angeles, claiming they violated the Information Practices Act by failing to maintain his exams and grant access to them.

Moghadam claimed university officials failed to provide him with copies of his midterm and final exams. He said the officials destroyed the exams after he requested copies.

Moghadam also alleged that the university maintained inaccurate and irrelevant information in his file, and that the university did not have a comprehensive IPA compliance plan.

"Student exams are not records containing personal information within the meaning of the IPA," Justice Suzukawa ruled. "Defendant's alleged refusal to allow plaintiff to inspect or copy his exams, thus, does not violate the IPA as a matter of law."
