PITTSBURGH (CN) - Two coal companies challenge the constitutionality of Blaine Township's "Anti-Corporation Ordinance," which prohibits corporations "with a consistent history of violating the law from doing business within Blaine Township."
Penn Ridge Coal and Allegheny Pittsburgh Coal say Blaine's "Anti-Mining Ordinances" also are unfair and unconstitutional. It wants enforcement of the laws enjoined.
The mining ordinances are environmental laws. The Anti-Corporation Ordinance requires that companies disclose, among other things, "consistent violations," defined as three or more violations within 20 years, and violations of environmental laws.
