Clubgoer Sues Over Sex Assault, Broken Jaw

(CN) - A one-time patron of a now-shuttered hookah lounge and bar in Virginia Beach claims in court that she was sexually assaulted by a bouncer at the club during a night out with friends in 2013.

In a complaint in Virginia Beach Circuit Court, plaintiff Jessica Biersack acknowledges she has very little memory of what transpired at the Gravity 107 nightclub on the night of Nov. 16, 2013.

She says she was drinking with friends, and had possibly been drugged, at another nightclub, the Bayside Bar and Grill, when she ventured out to the sidewalk and struck up a conversation with Gravity bouncer William Good, a few doors away.

At the time, Biersack said, it was clear to both Good and co-defendant Timothy Reagan, Jr., Gravity's manager, that she intoxicated.

In fact most of what she describes in the complaint appears to come from later statements by Reagan, whom she quotes as observing that she was "all over" Good as they stood outside the club.

She also says Reagan later saw she and Good making out in the bouncer's truck, but that Good told his manager he ultimately got "shot down" by the young woman.

Later, "Reagan watched Good follow the plaintiff away from Gravity, and leave his security guard post to stalk the plaintiff," the complaint says.

Biersack claims Good forced her to a secluded location, where he sexually assaulted her and "Negligently injured the plaintiff, knocking out a tooth and breaking her jaw."

Afterwards, "Good left the plaintiff naked and injured in a secluded area behind a shed," the complaint says.

Biersack says while all of this was occurring, her friends noticed she was missing and went to look for her. They ran into Reagan, who, the complaint says, "lied, and told one of the plaintiff's friends that the plaintiff was walking in a different direction ... so he could 'buy' time for Good."

Biersack says when she regained consciousness, she ran to a nearby apartment and knocked on a door until the residents answered and provided her with assistance.

In the meantime, the complaint says, Good returned to Gravity, "hiding his right hand under his sleeve."

Good later confessed to what happened to Virginia Beach detectives, and entered guilty pleas to criminal charges of sexual battery and malicious wounding.

In March 2015, he was sentenced to 20 year on the malicious wounding charge and 12 months for sexual battery. The judge suspended all but eight years.

Biersack seeks $4 million in compensatory damages and $1 million in punitive damages on claims of negligence, gross negligence, negligent hiring and retention, and negligent infliction of emotional distress.

She is represented by Edwin Booth of Shapiro, Appleton & Duffan, P..C. in Virginia Beach, who told Courthouse News that his client is eager to bring the case to trial and is hopeful justice will prevail.

"We look forward to seeking justice from our Virginia Beach jury," Booth said.

Representatives of the now-defunct Gravity 107 could not be reached for comment. Good is reportedly still in jail and was also unavailable for comment.
