Cleveland Teachers Fight Mass Firing

CLEVELAND (CN) - The Cleveland Metropolitan School District violated a collective bargaining agreement by telling 1,400 teachers they will lose their jobs at the end of this school year and must reapply for them, the teachers union claims in Cuyahoga County Court. The district told the teachers about this on June 3, violating terms of the collective bargaining agreement that is still in force, the teachers say.

The Cleveland Teachers Union, AFT, Local 279, AFL-CIO, seeks a restraining order and injunction restoring the status quo ante until the issues can be litigated.

The teachers say the district and its co-defendant Superintendent Eugene Sanders worked out their "Transformation Plan," secretly, in violation of the collective bargaining agreement, then presented teachers with a fait accompli.

The Transformation Plan assigned every school to one of four categories: Repurpose, Refocus, Growth or Monitor.

All the teachers at the Repurpose schools received the letter telling them that "all teaching positions at the Repurpose Schools will be required to reapply for their positions and will be required to compete for their positions with any other teachers who might also apply," according to the complaint.

The union says that violates the collective bargaining agreement, which does not expire until June 30.

They want a restraining order, injunction, and a hearing. They are represented by Susannah Muskovitz with Faulkner, Muskovitz & Phillips.
