LOS ANGELES (CN) - Topps claims its "Bowman Draft Picks & Prospects" baseball cards include one "autographed prospect card" in each box, but that's not the case, a class action claims in Superior Court.
Named plaintiff Greg Perez claims he bought eight boxes of the cards at $54 a box from co-defendant Franklin's Sports Card. Each box has 24 packs with seven trading cards in each pack. "The trading cards came in box labeled 'Bowman Draft Picks & Prospects - Home of the Rookie Card.' The trading box stated: 'One Bowman Chrome Autographed Prospect Card in Every Box,'" according to the complaint.
But after spending $432, Perez says, he opened all the packs in six boxes, "and discovered that none of the boxes contained a Bowman Chrome Autographed Prospect Card."
He says similar things happened to him on multi-box purchases of the cards in 2007 and 2006.
He wants an injunction and punitive damages for fraud, negligent misrepresentation, consumer law violations and violations of the Autographed Sports Memorabilia Act. The class is represented by Greg Hafif.
