Class Disputes Ads for Contact Lens Cleaner

SANTA ANA, Calif. (CN) - Advanced Medical Optics falsely advertised its "Multi-Purpose Solution Easy Rub Formula" contact lens cleaner as "new and unique," though it's an old product the company rushed back to market after the company recalled another product under pressure from the FDA and Centers for Disease Control, a class action claims in Orange County Court.

The class claims that Advanced Medical Optics falsely advertises that Easy Rub contains "enhanced protection" to soothe public fears after a series of recalls of contact lens cleaners.

It claims that Easy Rub is "an old Allergan product" developed in the 1990s, and is neither "unique" nor "new." It claims Advanced Medical Optics "hurriedly 'reintroduced' [it] to the market after AMO recalled another multi-purpose contact lens solution under pressure by the Food and Drug Administration and the Centers for Disease Control in May 2007. The formula contained in Easy Rub was developed n the 1990s by Allergan Inc., AMO's predecessor, and has been manufactured and/or distributed by AMO and retailed by Costco as a 'private label' brand ('Kirkland Signature') since at least 2003."
