ST. LOUIS - South & Associates systematically overstates attorney's fees and borrowers' debts, a class-action complaint claims in Federal Court. Named plaintiff Randal Howland says South violates the Fair Debt Collection Practices Act by sending letters to borrowers containing the amount owed on their mortgage.
South acts as a debt collector and attempts to collect attorney's fees that are not owed or earned, and has no records to support such charges, the suit states. Howland says South also overcharges for other services, such as certified mail, at prices well above those he incurs. The class consists is represented by Jonathan Andres of Clayton, Mo.
