City Fights Newspaper’s Records Request

CLAYTON, Mo. (CN) - A St. Louis suburb asked a judge to decide whether it must give the St. Louis Post-Dispatch a document the newspaper requested on payment of firefighters' overtime.

The City of Brentwood says the paper requested a copy of a letter of understanding on repayment of overtime between Brentwood and Local 2665, IAFF, the union that represents Brentwood's firefighters.

Brentwood claims the letter is a closed record, but a pending federal case (Ishmon v. St. Louis Board of Police Commissioners) has put that conclusion in doubt.

Brentwood asked St. Louis County judge to determine whether the letter is an open or closed record.

The Post-Dispatch reported on Aug. 16 that Brentwood, 10 miles west of St. Louis, is subject to a Missouri state audit after a former city administrator admitted embezzling more than $30,000.

In that article, the Post-Dispatch reported that Brentwood residents were concerned that firefighters may have received overtime pay for time they did not work, and that improper overtime payments have been made to Brentwood firefighters for more than 20 years.
