(CN) - Ohio cities cannot require residents to live in the towns where they work, the Ohio Supreme Court ruled. The justices rejected laws enacted by Lima and Akron mandating that city employees live within city limits.
According to state law, "no political subdivision shall require any of its employees, as a condition of employment, to reside in any specific area of the state."
Both cities challenged the state law, lost at the trial court level, but prevailed in appeals court.
Justice Pfeifer resolved this conflict by ruling that the state law supersedes the local requirements.
The law "provides for the comfort and general welfare of public employees by ensuring that they will be able to choose the municipality where they reside," Pfeifer wrote.
