Circuit Won’t Rehear Fantasy Baseball Case

ST. LOUIS (CN) - The Eighth Circuit declined to rehear an appeal by the Major League Baseball Players Association and Major League Baseball Advanced Media seeking to reverse a ruling that let a fantasy baseball company use players' names and statistics without paying a licensing fee.

The circuit ruled last month that CBC Distribution and Marketing is not required to pay the players. The MLBPA had argued that CBC should have to pay to use players' names and stats the way companies would pay athletes to endorse products.

Fantasy league participants create online fantasy teams based on real MLB players and track their statistics during the season, competing against other fantasy teams based on their fantasy players' actual performances.
