MANHATTAN — The Second Circuit upheld a ruling in favor of the CIA in a Freedom of Information Act suit brought by The New York Times, which sought an acknowledgement from the agency that it was aware of the existence of records relating to a covert program of arming and training Syrian rebels. 

The court ruled that certain statements made by President Donald Trump and General Raymond Thomas did not “officially acknowledge or inadvertently declassify the existence of such a program.”
