Chocolate class action

SAN JOSE, Calif. — The Hershey Company could not totally dodge class claims from consumers who say the company sells Lily’s branded chocolates that claim to have “no sugar added” or “less sugar” without providing any kind of reference food, as required by the FDA. Several claims are tossed for lack of standing, as the class representative couldn’t show she actually bought some of the chocolates in dispute, but a few unfair business practices claims survive on the theory that Hershey violated California regulations when it failed to put the proper reference disclosures on the chocolates’ packaging.
