Chief on the hook for excessive force

JACKSON, Miss. — A federal court in Mississippi denied summary judgment to a city’s police chief, who argues that a criminal suspect’s arrest for disorderly conduct and resisting arrest prevents him from suing the chief for damages. The court finds the claims are not barred. The suspect says that after he was placed under arrest, handcuffed and advised of the charges, the chief instructed three officers to hold him down as the chief tasered him for several seconds “despite the fact that he was already subdued, was not resisting, and did not pose a threat.”
