(CN) - The Chicago Transit Authority can't ban "mature" or "adult" video game ads on its buses and trains, a federal judge has ruled. U.S. District Court Judge Rebecca Pallmeyer said the transit authority's Jan. 1, 2009 rule banning suggestive ads violates the First Amendment.
Entertainment Software Association, an industry group of game makers and sellers, sought an injunction in July 2009 to stop the transit authority from enforcing its ordinance.
In her 22-page opinion, Pallmeyer said the gaming industry is "likely to succeed in establishing that (the Chicago Transit Authority's) advertising system retains its character as a public forum for expression."
The CTA disagreed with the ruling and said it's reviewing its options.
