Casino Sued for Booting Guest, Post-Robbery

LAS VEGAS (CN) - A Fijian national wants the Vegas Luxor Hotel and Casino to pay him more than $10,000 in damages, claiming hotel staff kicked him out after he reported that money was missing from his room.

Suresh Chand Shankar, who filed suit at the Clark County District Court, says that Luxor management "belittled" him, called him a liar and accused him of drunkenness.

Shankar, who says in his complaint that he "can appear Middle-Eastern, and speaks far from perfect English," claims that when he produced papers proving he was staying at the hotel, a Luxor manager, in a "fit/tiff," called the police and forced him off the premises.

Before ejecting him, Luxor staff tried to run his credit card and refused to let him get his things from his room - including his heart and diabetes medications, according to the complaint.

"Luxor personnel ... failed in all respects to show any dignity or courtesy to the plaintiff and took plaintiff into custody, thereby confining plaintiff," the suit alleges.

Shankar says he was arrested for trespass and an "attempt to defraud an innkeeper," and was let go only after posting $3,000 bail.

When he returned to the Luxor he tried to retrieve his belongings, but found more had gone missing, including business papers, which he believes were "either stolen, lost or destroyed in his absence."

Among other allegations, Shankar accuses Luxor owner, Ramparts Inc., and various unnamed hotel employees of breach of contract, conversion, false imprisonment and defamation.

"Through pantomime as well as express overheard words of the Luxor's employees ... it was communicated to all present that the plaintiff was an odious person" and that he "was guilty of some crime," Shankar claims.

Shankar is represented by Robert Nersesisan with Nersesisan & Sankiewicz.
