Case Of Falling Worker|Still Up In The Air

NEW YORK CITY (CN) - A telephone worker who fell through an office ceiling was working under an elevation risk, the New York appellate court ruled.

However, Lawrence Becker was denied summary judgment because a jury could find that he may have caused his own injury while leaping from plank to plank in the ceiling.

ADN Design Corp. also tried to assert that Becker was merely performing routine maintenance, but the appellate judges denied the claim because it was raised for the first time on appeal.
