Cardinals Fans Go to Court Over Tickets

EDWARDSVILLE, Ill. (CN) - The Sporting News called St. Louis Cardinals fans the best in baseball. Now two fans have taken their fight over Opening Day and All-Star game tickets to Madison County Court.

Patrick Berger sued Samm Tague for sole possession of two season tickets.

Berger claims he was forced to sue after Tague threatened to sue him.

"Defendant's motivation in threatening legal action against plaintiff is defendant's desire to obtain plaintiff's 2009 opening day tickets and plaintiff's option to purchase tickets to the 2009 major league All-Star game and related events," the complaint states.

Berger's attorney Michael Hertz attached a letter outlining the agreement. According to the letter, last season Berger kept the Opening Day tickets and he and Tague split the other 80 games. Tague sent Berger a $100 deposit on Oct. 9 and Berger sent it back on Dec. 1.

"In dispute is whether or not the plaintiff has agreed to sell tickets to the defendant in a similar fashion for the upcoming 2009 season," the complaint states. "No agreement between the parties was reduced to writing ... Plaintiff has tangible interest in keeping his 2009 season tickets and being allowed to use or sell these tickets at his discretion ... Plaintiff is inhibited from planning how to use his 2009 season tickets due to the current state of unsettled affairs."
