Cancer Society Says Employee Embezzled

AUSTIN (CN) - The American Cancer Society says an employee embezzled money and used it to buy cell phones from Nextel, then sold them and kept the money. The Cancer Society sued Sprint Nextel and John Phillip Martin, claiming Martin's acts have cost it $415,000 and counting.

The Cancer Society says defendant Sprint Nextel knew of and profited by the fraud, which is "evident from the fact that defendant Sprint refused to voluntarily turn over to the American Cancer Society Inc. records of all cell phone purchases initiated by defendant John Phillip Martin, even though defendant Sprint billed and accepted payment from The American Cancer Society Inc, for these cell phones."

The Cancer Society says the cell phones were "unprovisioned" or "unlocked."

The Cancer Society is represented in Travis County Court by Michael Duray of Dallas.
