California Sues EPA At 9th Circuit

SAN FRANCISCO - California today sued the EPA in the 9th Circuit, challenging the Bush administration's denial of the state's request for an EPA waiver to let California implement its own greenhouse gas emissions law to reduce tailpipe emissions by 30 percent by 2016. Attorney General Jerry Brown called the EPA's Dec. 19 denial "shocking in its incoherence and utter failure to provide legal justification for the administration's unprecedented action." petition for review

Bush's move was generally interpreted as a sop to the U.S. auto industry. See California's petition for review. See the EPA rejection letter.
