Calif. Courts Of Appeal

INSURANCE – Neighbors brought nuisance and environmental claims after a smelly compost facility sought to expand. J. Marchiano found that a pollution exclusion in State Farm’s policies for a compost facility bars coverage for liability for offensive odors emanating from the facility and spreading more than a mile away. See ruling.

CIVIL RIGHTS, CLASS ACTIONS – J. Perluss held that a stipulated judgment in a dispute concerning the searches of 11 prison visitors who were x-rayed by a machine that revealed feminine hygiene products, breast implants, bra underwires and diapers as possible contraband, is not a final appealable order. See ruling.
