ENVIRONMENT - Upon rehearing, the appeals court previously ruled that the water service portion of an environmental impact report must analyze the actual amount of water that will be available for a project. J. Gilbert found that the EIR for the West Creek residential subdivision satisfies all four principles that govern the analysis of the water services portion of an EIR. See ruling.

ARBITRATION, NEGLIGENCE - Surviving heirs claimed that a skilled care facility failed to provide adequate care to Lillie Rogers, resulting in her death. J. Willhite found that the arbitration agreements contained in Rogers' admission papers failed to comply with disclosure requirements because the disclosure appears in the middle of the page and is not highlighted in any way to distinguish it from other provisions.
