ATTORNEYS, CRIMINAL PROCEDURE - Defendant instructed his counsel to move for a new trial largely because he thought his counsel's performance at trial was deficient. The appeals court ruled that the trial judgeshould have allowed the defendant to present hiscase for ineffective assistance. See ruling.
