Calif. City Isn’t Liable for Injuries From Cow Attack

(CN) - A federal judge in San Francisco dismissed a hiker's claim that the city of Walnut Creek violated her constitutional rights by failing to prevent a cow from attacking her during a hike.

Jo Dee Schmidt said the city failed to prevent the attack by allowing cows to graze freely where people walk their dogs and hike.

Defendant Walnut Creek argued that it did not create the danger that harmed Schmidt, as "there is no constitutional right to be free from a cow attack."

U.S. District Judge Phyllis Hamilton agreed and dismissed the action.
