Calif. AG Seeks Supreme Court Review Of Prop 8

SACRAMENTO (CN) - California Attorney General Edmund Brown Jr. asked the California Supreme Court Monday to review the constitutionality of the recently passed California proposition outlawing gay marriage, proposing that the matter leapfrog over lower courts in the interest of expediency.

"Since both petitioners and respondents are asking that the passage of proposition 8 be reviewed immediately, it's likely the Court will take the case" says Christine Gasparac, the spokesperson for the Attorney General's Office.

She went on to say this is a civil rights case since proposition 8 deals with the separate treatment of homosexuals.

The Office of the Attorney General is defending the passage of the proposition, as is customary since the office represents the state.

Brown believes the Court will uphold the validity of homosexual marriages performed between June and November, when such marriages were legal.

Brown is against a stay on Proposition 8 since the legality of any resulting same-sex marriages established after the passage of the proposition would be in a chaotic legal limbo.

He hopes a decision by the California Supreme Court will provide finality on same-sex marriage.
