CA Sues T-Mobile and AT&T on Cellphones

LOS ANGELES (CN) - T-Mobile USA lied to its customers for four years by saying the voice mail on their cell phones would be secure without password protection if they lost the phones, the State of California claims in Superior Court. The state also sued AT&T Mobility on similar grounds.

In its complaint against T-Mobile, the state claims, "At certain times during the four years preceding the filing of this complaint, technical issues arose that allowed third parties using commercially available software unlawfully to access voicemail accounts of certain T-Mobile customers who did not have password protection enabled for their voicemail services. T-Mobile knew or should have known of these vulnerabilities. Although T-Mobile implemented technical solutions that prevented unauthorized access to T-Mobile cellular voicemail services after these vulnerabilities arose, T-Mobile did not advise its customers of the vulnerabilities during the times when the technical solutions were not effectively implemented."

The state seeks $2,500 in fines for each violation of Business and Professions Code section 17206, and an injunction against deceptive business practices.
