Brooklyn Woman Says ER Nurse Assaulted Her

BROOKLYN, N.Y. (CN) - A male nurse ejaculated on an incapacitated female patient in the emergency room of a New York City hospital, the woman claims in court.

The woman says she became the victim of a "sick and perverted attack" at Mount Sinai Beth Israel's emergency room a year ago in Brooklyn.

Though the complaint filed Wednesday in Kings County Supreme Court identifies the parties by name, Courthouse News has redacted this information because of the sensitive nature of the claims.

An ambulance allegedly rushed the woman to the hospital at about 2 p.m. in July 2014 after her knee gave out in a parking lot at a supermarket.

The plaintiff says she was given Percocet and an X-ray, the results of which she received at about 7:27 p.m., about 22 minutes after a male nurse put her on an IV of Toradol, a nonsteroidal anti-inflammatory drug.

Since the physician led her to believe that she would soon be discharged, the plaintiff says she called her son and said to pick her up in an hour.

The plaintiff says she repeatedly tried to leave the hospital over the next hour, but the male nurse who gave her the IV said they "needed a urinalysis - for her injured knee."

Still waiting on the phantom urinalysis, the plaintiff says her son agreed at 9 p.m. to wait in the car.

The plaintiff says the male nurse knew she was unable to walk when he entered the examination room where she was lying down.

After tucking the curtain into a handle so it wouldn't open, the nurse started "kneading" the woman's legs, according to the complaint.

He then allegedly put his mouth on her, shoved his tongue down her throat and put his hands between her legs.

The woman says she yelled "stop" and "don't," but "to no avail."

Her alleged assailant then ejaculated on top of the sheet that she used to keep her warm, the lawsuit states.

The nurse then threw the sheet into the linen bed, according to the complaint.

The woman brings the lawsuit to "vindicate her rights, to assert her dignity as a woman."

She seeks damages for battery, assault and false imprisonment.

In addition to the nurse, defendants to the action include Mount Sinai Beth Israel Brooklyn, Mount Sinai Hospitals Group Inc.; and Mount Sinai Health System Inc.

Mount Sinai has not returned a request for comment.
