‘Breaking Bad’ Artist|Says Sony Went Too Far

ALBUQUERQUE (CN) — The creator of the Pollos Hermanos restaurant logo for "Breaking Bad" sued Sony Pictures on Friday for using the image in merchandising without his permission.

Humberto Puentes-Segura created the image in 2008 as the logo of the show's fried chicken restaurant that was the front for Gustavo Fring's drug empire. The restaurant featured prominently in the long-running show, and during a 2015 Reddit "Ask Me Anything" presentation, "Breaking Bad" creator Vince Gilligan said there had been interest in creating a real restaurant based on it.

But in his federal lawsuit, Puentes-Segura says his contract with Sony Pictures allows them to use the image in the show, but not to license or sell merchandise using the image. He also sued Topanga Productions, a distributor and subsidiary of Sony, based, like Sony, in Culver City.

He claims that Topanga Productions has been licensing T-shirts, hats, and other merchandise bearing the logo. Puentes-Segura lives in Mexico, and says he did not learn about the trademark infringement until the fall of 2015.

Puentes-Segura says he copyrighted the image in January this year. He seeks an accounting, profits, damages and an injunction.

None of the parties could be reached for comment over the weekend.
