CLAYTON, Mo. (CN) - Signature Health Care Foundation fired a woman for taking leave of absence to donate a kidney to her ailing brother, the woman says. Signature fired her 3 days before the double surgery, though it already had granted her leave, Phyllis Delaney says in St. Louis County Court.
Delaney claims that Signature granted her request for 4 weeks of leave after doctors found she was a match for her brother, who needed the kidney to survive.
But Delaney says the company fired her on April 28, 2008, just three days before the scheduled surgery, claiming that it could not hold open her data entry position for 4 weeks.
Delaney says there were other workers who could have performed her job during her absence, at little or no extra cost to Signature. She says her brother was a disabled person under the Missouri Human Rights Act, which protected her too.
Delaney seeks reinstatement and punitive damages.
She is represented by Jonathan Berns with Dobson, Goldberg, Berns in St. Louis. Signature Health Care Foundation and Signature Health Services dba Signature Medical Group are named as defendants.
