Boss of the Day

LOS ANGELES (CN) - A man claims his female boss at a toy store "had a habit, pattern and course of conduct and a history of striking and assaulting and battering male employees in their genitals," and he demands damages for sexual harassment and assault and battery.

Stacy Gregge Jr. sued Entertainment Earth, of North Hollywood, and his boss, Nga To, in Superior Court. Nga To was, of all things, a "human resources/operations manager," according to the complaint.

Gregge claims To "assaulted and battered" him "by kicking him in his genitals," and says he suffered "severe and extreme personal injuries as a result of the assault and battery and kick to his genitals and was hospitalized as a result."

Gregge adds that To "did not act in a similar fashion toward female employees."

He claims that higher-ups at Entertainment Earth "were at all times aware of" To's proclivity, they took no steps to stop it.

"In early 2010, the defendant To attempted to kick plaintiff in his groin. Plaintiff blocked To's kick and assault and told her not to do this again."

But "on March 8, 2010, plaintiff was walking to his work station when he was approached by To and asked for some insurance enrollment forms," the complaint states. "Plaintiff told her that he did not have the documents there, but would have them by the end of the day. The defendant To then assaulted and battered plaintiff by kicking him in his genitals. Plaintiff immediately fell to the ground writhing in pain. ... This assault and batter was witnessed by various employees, including supervisors employed by the employer defendants, who did nothing except laugh. Plaintiff's supervisor, after observing the assault, told plaintiff, 'you deserved that. ...'

"Plaintiff suffered severe and extreme personal injuries as a result of the assault and battery and kick to his genitals and was hospitalized as a result."

Gregge seeks punitive damages and medical expenses. He is represented by Michael Baltaxe of Westlake Village.
