SAN DIEGO (CN) - Federal trial begins today for a Border Patrol agent accused of strangling an undocumented into unconsciousness.
"According to court documents, [agent Luis E.] Fonseca, acting under color of law, used unreasonable force when he strangled an undocumented alien to unconsciousness on July 26, 2011," the U.S. Attorney's Office said in a statement.
Fonseca, 32, is accused of kneeing and choking an immigrant in Imperial Beach.
He is charged with deprivation of rights under color of law, in violation of 18 U.S.C. § 242.
He was indicted on April 12, 2012, and a grand jury handed up a superseding indictment on Dec. 13.
The trial is expected to last for 3 to 4 days.
