Border Patrol Ran Over Immigrants, Suit Says

TUCSON (CN) - A U.S. Border Patrol truck ran over an immigrant and his 12-year-old daughter while pursuing other border jumpers, killing the girl, her estate claims in Federal Court.

Attorney Benjamin Burnside filed a wrongful death action on behalf of Lourdes Cruz Morales, the girl killed while walking through the desert with her father near Yuma, Ariz. Driver Gregario Garcia was speeding and lost control of his truck when he hit the two pedestrians, the lawsuit claims. Juan Cruz Torralva, the father, survived with permanent injuries, while his daughter "lay suffering in the desert in excruciating pain before she passed away."

Her estate sued the Border Patrol, the federal government, the U.S. Department of Homeland Security, and agent Garcia and his wife for damages. Burnside is represented by Bellovin & Karnas P.C.
