Bonkers at the Pizzeria

DALLAS (CN) - A pizzeria worker stripped a customer and beat him with a metal pipe after his credit card was rejected, the man claims in court.

Hermilo Aguilar-Martinez sued Michael Liebermann and the Pizza Lounge, in Dallas County Court.

Aguilar claims he was eating at the Pizza Lounge restaurant on Oct. 13, 2010, and tried to pay with a credit card in someone else's name.

"When the card was declined, defendant Liebermann became angry, ordered plaintiff to leave, and then escorted plaintiff outside the restaurant with the aid of an employee of Pizza Lounge, Kyle Bachman," the complaint states.

"Liebermann began assaulting plaintiff about his upper legs and body by striking plaintiff with a metal pipe or broom/mop handle."

After the preliminary beating, Aguilar says, Lieberman "instructed" him "to remove his clothes."

"When plaintiff did not comply, defendant Liebermann removed plaintiff's clothes and then continued striking plaintiff's unclothed body."

The Pizza Lounge called police and Aguilar was arrested and jailed on a felony charge of credit card abuse, which was no-billed by a Dallas County grand jury, according to the complaint.

Liebermann admitted to police that he did beat Aguilar with a metal pipe or broom handle and removed his clothes, the complaint states.

Liebermann was then indicted on a felony charge of aggravated assault with a deadly weapon and he pleaded guilty on Aug. 1, the complaint states.

Aguilar-Martinez seeks damages for assault, vicarious liability and intentional infliction of emotional distress. He is represented by Don Tittle of Dallas.
