PORT ST. LUCIE, Fla. (CN) - A woman claims in court that she was "disfigured" when "projectile cubes" popped out of a bank's 3-D advertisement and hit her eyeball, causing her to fall.
Nancy Lewis and her husband sued Seacoast Banking Corp. of Florida, and the companies that designed the mailer, Design Horizons and Dimensional Communications, claiming negligence.
Nancy Lewis claims she was "severely, significantly and permanently injured in or about her head, neck, body, limbs, and nervous system."
According to the complaint in St. Lucie County Court, Seacoast Banking sent Lewis an unsolicited "3-D Jumper" direct mail advertisement, and when she opened it, "projectile cubes shot outward as designed and intended, striking Ms. Lewis in the eye and causing her to fall backward and sustain significant personal injury."
Lewis claims she was "permanently and significantly scarred and/or disfigured" by the accident.
She claims Seacoast Banking failed to warn recipients of the jumping items and to ensure the ad was properly designed.
She seeks more than $15,000 in damages for "extreme mental and physical suffering." Her husband seeks damages for loss of consortium.
She is represented by David Gordon in Melbourne.
