CHICAGO (CN) - Rod Blagojevich's legal defense team has several complaints about the government's investigation of the former governor's alleged corruption. Blagojevich's brother, Robert, who also is a federal defendant, claims the FBI overstepped its authority by secretly taping phone conversations he had with his wife.
Rod Blagojevich is accused of trying to sell the U.S. Senate seat vacated by President Barack Obama. The Illinois Senate ousted Blagojevich as governor in January 2009.
Rod Blagojevich's attorney, Sam Adam, also claims that investigators aren't turning over evidence to the defense fast enough.
The Chicago Tribune reports that prosecutors are revising the indictment against the former governor, and will refile it this week, to restrict its reliance upon the "honest services" fraud law, which is under review by the U.S. Supreme Court.
Robert Blagojevich's attorney, Michael Ettinger, says the FBI tapped and recorded more than 1,500 of his phone calls, and that more than 200 of them were between Rob Blagojevich and his wife or son.
Rod Blagojevich's trial is scheduled to begin on June 3.
