(CN) - A "birther" lacks standing to challenge Barack Obama's eligibility to run for president and serve as the nation's leader, the 3rd Circuit ruled.
Birthers believe that Obama is ineligible for office because he was born in Kenya, not Hawaii, as his birth certificate states. A president must be a "natural born citizen" under the U.S. Constitution.
The three-judge federal appellate panel in Philadelphia said plaintiff Philip J. Berg, a lawyer, "lacks standing to bring this suit because he has suffered no injury particularized to him."
