Beaten Over a Tomato

A man who was arrested and beaten by an off-duty police officer after a Walmart store’s loss prevention officer believed she saw him shoplifting a tomato may pursue his false imprisonment claim against the store, a Georgia appeals court ruled. The man had paid for his groceries, including the tomato, but believed he had been overcharged for the tomato and had gone back to the produce department to weigh it.
