BB Guns

An appeals court in New Mexico ruled that a minor was properly convicted of assault and carrying a deadly weapon after bringing a BB gun to school and threatening to shoot his principal, whose discovery of a CO2 cartridge and observation of a bulge in the student's waistband proved the child “used” the weapon while making the threats. 

ALBUQUERQUE, N.M. – An appeals court in New Mexico ruled that a minor was properly convicted of assault and carrying a deadly weapon after bringing a BB gun to school and threatening to shoot his principal, whose discovery of a CO2 cartridge and observation of a bulge in the student's waistband proved the child “used” the weapon while making the threats.
