PROVIDENCE, R.I. (CN) - After a bat attacked a family in their apartment, a pest control company caught it and released it into the wild without testing it for rabies, forcing the family to get medical treatment, they claim in court.
Donna Resmini and her son et al. sued Allstate Pest Control et al., in Providence Superior Court.
Resmini claims she called the pest control company after finding a bat flying around in her rented house in June 2011. She says the bat had "come in contact" with her and hers on.
Allstate's employee caught the bat with a net and released it to fly away, she says then told her "that it would be a good idea to seek medical treatment due to their contact with the bat."
She claims that all the occupants of the house had to seek medical treatment, and that the exterminator should have kept the bat and had it tested for rabies.
She seeks damages for negligence, strict liability and negligent infliction of emotional distress.
She is represented by Wayne Resmini.
Bats, a flying mammal, inspire great fear in humans, due in part, no doubt, to their semi-human faces, and to Bram Stoker's 1897 novel, "Dracula."
