SAN FRANCISCO — The Ninth Circuit upheld a jury verdict that awarded millions in damages to the family of a man who was fatally shot by a Bay Area Rapid Transit police officer in 2018, finding there’s “substantial evidence” to support the finding that the victim was trying to surrender before Joseph Mateu III opened fire and that his use of deadly force was unreasonable.
